Such modification in these projects does not alter in any way the conditions of the loans given or their terms and, of course, you may continue to participate directly as before in the meetings of lenders of such projects, thus maintaining unchanged your rights and obligations to the platform and, above all, to the developer as lender of each project in which you are an investor.

Falls das von Housers* gesagte zutreffend wäre, es keine Interpretationsfragen oder Ausnahmen gibt, dann wären m.E. von einer solchen Ändeung vermutlich mehrere Plattformen tangiert? Hmm hab mir den Wortlaut von 3.6. angeschaut

Das lese ich jetzt aber so, dass der Einsatz von SPVs schon generell weiter zulässig ist und die Anforderung nur ist, dass in einem SPV maximal ein Asset ist (in dem Fall also eine Immobilie. Sieht also eher so aus, als hätte Housers* zuvor eine ungünstige Struktur gewählt und müsse daher nun ändern. _________________ Meine Investments (aktualisiert 12/24):
